Judge turns down Thornhill Green injunction
SEP 5, 2008 Thornhill Green Co-op and CHF Canada were in Court on July 18 in an attempt to stop the forced sale of the co-op to York Region’s housing company. We sought an injunction to have a stay of the proceedings while a full judicial review of the case was heard. Judge Morawetz, did not grant the injunction. This means that, unless the decision is successfully appealed, the hearing on the sale of the co-op will now proceed.
Thornhill Green and CHF Canada continue to believe that York Region's actions are an unwarranted attack on an independent, community-based housing co-operative and are very disappointed that the judge did not agree to put the sale hearing on hold while the underlying issues are dealt with. We have instructed our legal counsel to pursue an appeal of the decision. There are a number of substantive issues we raised that we would like an appeal court to look at.
